Sober is not responsible for the availability (or lack of availability) of such external sites or resources. If you decide to interact with third parties using the Service, your relationship with them is governed by the terms of such third parties. Sober is not responsible for such conditions or actions of third parties.
  12. Limitation of Liability. PURSUANT TO APPLICABLE LAW, COMPANY Sober (Sober), ITS AFFILIATES, EMPLOYEES, LICENSORS OR SERVICES SUPPLIERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, CONTINGENT, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING, DIRECT OR CONSEQUENTIAL LOSS OF PROFIT OR ANY LOSS OF DATA, POSSIBILITY TO USE, LOSS OF REPUTATION OR OTHER INCOMPLETE DAMAGES INCLUDED AS A RESULT OF: (I) YOUR ACCESS TO OR NOT USE; (II) ACTIONS OR MATERIALS OF OTHER SUBSCRIBERS OR THIRD PARTIES, PERFORMED OR RELATED TO THE SERVICE; (III) UNAUTHORIZED ACCESS, USE OR ALTERATIONS OF YOUR MATERIALS, EVEN IF Sober WAS KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL LIABILITY OF Sober UNDER ALL CLAIMS RELATING TO THE SERVICE CANNOT EXCEED THE LARGE AMOUNT PAYED BY YOU TO TINDER FOR THE SERVICE AND USD10 IF YOU ARE AVAILABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSION OR LIMITATION IN THIS SECTION MAY NOT APPLY.
  13. Arbitration, class action waiver and jury waiver, user waiver of legal action. With the exception of subscribers residing in the European Union, European Economic Area and other countries where this is prohibited by applicable law:
  14. The sole means of resolving any dispute or claim arising in connection with this Agreement (including any alleged violations of this Agreement) or the Service is Binding ARBITRATION at the JAMS Arbitration, Mediation and Alternative Dispute Resolution Center in accordance with the JAMS Arbitration Rules, with the exception of provisions contrary to the provisions of our Arbitration Procedures. The only exception to this exclusivity clause is the right of either party to bring separate claims against the other party to the small claims court of the applicable jurisdiction, or, if the claim has been filed in arbitration, the respondent may request that the case be continued in small claims court if the claim the claim falls under the jurisdiction of the small claims court. If an application for referral to small claims court is filed before the appointment of an Arbitrator, the arbitration shall be terminated administratively. If a petition for referral to small claims court is filed after the appointment of an Arbitrator, the Arbitrator determines whether to proceed with arbitration or refer it to small claims court. Such arbitration shall be conducted in writing only, unless you or Sober decide to exercise the right to an oral hearing in the presence of an arbitration judge. If you choose arbitration or small claims court, you agree not under any circumstances to initiate, support or participate in any class action, other legal action, class arbitration or other representative action or process against Sober.
  15. By using the Service, you agree to the above arbitration agreement. In this case, YOU REFUSE YOUR RIGHT TO APPLY TO THE COURT to make a claim or defense in the framework of the relationship between you and the Company (with the exception of issues that may be considered by the small claims court). YOU ALSO WASTE YOUR RIGHT TO PARTICIPATE IN CLASS SUITS OR OTHER CLASS PROCEEDINGS. If you bring a claim against Sober outside of small claims court (and Sober does not file a petition to transfer your claim to small claims court), your rights will be determined by a NEUTRAL ARBITRATOR, NOT a JUDGE OR JURY, and the Arbitrator will rule on all claims and all other issues in connection with the possibility of considering a dispute in arbitration. You have the right to a fair hearing by an arbitrator. In general, the Arbitrator has the right to provide all the remedies that the court can provide, including the possibility of considering a case out of court (including hearing a case out of court based on statements by the parties or considering a case out of court based on statements by the parties and evidence presented), however, it should be borne in mind that arbitration in general is a simpler and more convenient process compared to court and other forms of legal proceedings. An arbitrator’s decisions can be enforced in court and can be overturned by a court for limited reasons. For information on the arbitration process, please see our Arbitration Procedures.
  16. Any litigation for the purpose of enforcing this arbitration agreement, including any litigation for the purpose of confirming, modifying or exempting from enforcement of an arbitral award, may be commenced in any court of competent jurisdiction. In the event that this arbitration agreement is found to be unenforceable for any reason, any legal action against the Company (with the exception of small claims court cases) can only be initiated in federal or state courts located in the Małipolskie Krakow District. You hereby unconditionally agree to the jurisdiction of these courts in this context.
  17. The European Commission’s online dispute resolution platform is available at http://ec.europa.eu/odr. Sober does not participate in consumer arbitration dispute resolution procedures for subscribers residing in the EU or the European Economic Area.
  18. Guarantee of indemnification and protection from liability by the subscriber. You agree (to the extent permitted by applicable law) to protect and indemnify Sober, our affiliates, them and our officers, directors, agents and employees from any claims, demands and obligations, as well as reimburse damages, costs and expenses, including attorney’s fees arising from or related in any way to your access to or use of the Service, your Materials, or your breach of this Agreement.
  19. Exhaustive Agreement and Other Terms. This Agreement, as well as the Privacy Policy, Cookie Policy, Security Advisories, Arbitration Procedures (if applicable to you) and any terms disclosed and agreed with you when purchasing additional features, products or services that we offer within the Service, represent is the entire agreement between you and Sober regarding your use of the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement will remain in full force and effect. The Company’s refusal to exercise or apply any rights or provisions of this Agreement does not mean a refusal to exercise or apply such right or provision in the future. You agree that your Sober account is non-transferable and all of your rights in relation to your account and Content will cease upon your death. This Agreement does not create a joint venture, agency, partnership, employment, fiduciary or any other relationship. However, you do not have the right to make any statements or assume any obligations on behalf of Sober.
